To approve that the freehold of the Down Cemetery is transferred to Trowbridge Town Council as soon as reasonably practicable.
This was previously approved as part of Cabinet Member decision HSAAT-01-23, however it was not possible to effect the transfer by the transfer date of 1 April 2024 proscribed in that decision.
I approve that the freehold of the Down Cemetery, Trowbridge, is transferred to Trowbridge Town Council, as soon as is reasonably practicable.
This decision was made on 1 July 2024, and will come into effect on9 July 2024.
The Cabinet Member decision HSAAT-01-23 which came into effect on 31 March 2023 set out at length the justification for the service delegation and asset transfer to Trowbridge Town Council, and that the proposal was in accordance with the council’s policy criteria and supported by financial reasoning.
Those reasons remain in place. Due to the initial date for the transfer of the freehold of the Down Cemetery having passed, it is considered necessary and appropriate to ensure the completion of the policy compliant service delegation and asset transfer by putting in place further authority to allow for that transfer as soon as reasonably practicable.
To not amend the service delegation and asset transfer package – this would prevent completion of the agreement made in accordance with council policy.

As a minor technical adjustment to the previously approved Cabinet Member Decision HSAAT-01-23, no additional consultations were considered to be required in this instance.
