Purpose:

To ask the Cabinet Member for Highways, Transport & Waste to consider whether the Council should grant a request from Prospect Land Ltd to apply to the magistrates’ court for an order stopping up highway rights over part of the highway leading from Brook Lane on the Northacre Industrial Park, Westbury on the ground that the highway is unnecessary for public use or any other highway-related reason.

 

The section of highway concerned is shown cross-hatched on the plan at Appendix 1.  

Decision:

To consent to the application to stop up the highway at part of Brook Lane, Westbury.

 

This decision was made on 3 July 2018 and will come into force on 11 July 2018.

 

 

Reasons for the decision:

Officers consider that the highway concerned can be stopped up as it is unnecessary for public use and the Council can accordingly apply to the court for an Order.

Alternative options considered:

The Cabinet Member may resolve to:

 

(i) Give consent to the application

 

(ii) Refuse to give consent to the application, in which case reasons should be given for doing so.

 

Other reasons / organisations consulted

On 19 January 2018, Westbury Town Council consented to the application being made and a copy of the signed consent form is shown at Appendix 2.

 

The local member, Cllr Russell Hawker has made no comment on the proposal.
