To ask the Cabinet Member for Highways and Transport to consider whether the Council should grant a request from Mr. Henry Pelly of Luccombe Mill, Imber Road, Bratton to apply to the magistrates’ court for an order stopping-up highway rights over a section of highway at Imber Road, Bratton on the ground that the section concerned is unnecessary for public use or any other highway-related reason.
The section of highway concerned is shown cross-hatched in black on the plan at Appendix 1.
I consent to the proposed application.
This decision was published on 8 April 2022 and will come into effect on 20 April 2022 .
Officers on consideration of the matter were initially of the view that the section of highway concerned could potentially be stopped-up. However, on reviewing representations made by the Rights of Way Team, in particular concerning the use of the highway by non-motorised users, they are of the view that an application cannot be made as the highway is necessary for public use.
The Cabinet Member may resolve to:
(i) Give consent to the application
(ii) Refuse to give consent to the application, in which case reasons should be given for doing so.

On 11 March 2020, Bratton Parish Council consented to the application being made. A copy of the signed consent form is shown at Appendix 2.
The local member, Councillor Suzanne Wickham has no objection.
